Twenty-seven Tylenol lawsuits filed against McNeil-PPC, Perrigo, Novartis and others have recently been consolidated under multidistrict litigation in the Eastern District of Pennsylvania to facilitate the pretrial proceedings in these cases.

While the defendants in these cases, including McNeil, Perrigo and Novartis, opposed consolidation of the Tylenol lawsuits, arguing that the cases will depend on plaintiff-specific facts, the Judicial Panel on MDL overruled this opposition and has centralized the Tylenol lawsuits under the oversight of Judge Lawrence Stengel for pretrial proceedings.

In its ruling regarding the centralization of the Tylenol lawsuits, the Judicial Panel explained that, because all of the claims involve allegations of liver injury associated with the use of OTC Tylenol, the cases share factual issues regarding the design, manufacture, labeling, marketing and sale of Tylenol. Consequently, the centralization of these cases in the Eastern District of Pennsylvania would eliminate duplicative discovery, prevent inconsistent pretrial rulings and would ultimately conserve the resources of the parties, the counsel and the judiciary. The Judicial Panel also pointed out that Judge Stengel has the discretion to only rule on the common issues in the cases and, if he sees fit, remand the remaining issues in the respective cases to their original courts to finish resolving the individual claims.

As to why the Eastern District of Pennsylvania was selected as the jurisdiction for MDL 2436, the Judicial Panel explained that a number of Tylenol lawsuits are already been adjudicated in this district and that this district is closely located to the headquarters of both McNeil and Johnson & Johnson, making much of the defendants’ witnesses and other evidence easily accessible to all parties involved in these Tylenol lawsuits.
