A new hernia mesh lawsuit has been filed in the U.S. District Court for the Eastern District of Louisiana. The plaintiff made a claim back in April of this year that the hernia mesh device that was implanted to help assist in healing his inguinal hernia had instead generated life threatening injuries including but not limited to a cancer misdiagnosis. The plaintiff claims that the hernia mesh that was implanted in him was defective and poorly manufactured. He states that sufficient warnings of the device were not provided prior to his surgery. He is seeking compensation for damages in over $1 million dollars.
After being implanted the first time for his inguinal hernia back in 2009, the plaintiff followed through a very similar procedure five years later to repair it again. The surgeons used a Gore Micromesh product, which failed 10 weeks after implantation after which the hernia recurred, so a third surgery was needed. For the third surgery, the Bard Sorbafix Absorbable Fixation system was implanted. Afterwards during a routine check-up, the plaintiff revealed to his doctor that he was experiencing pains, tightness and a bulge in the area of the hernia repair surgeries took place.
After a CT scan of the area, the radiologists referenced a “mildly enlarged mesenteric lymph node,” an “enlarged central mesenteric lymph node,” and a “mild enlarged periotic and common iliac lymph nodes.” It was then told to the plaintiff that this was indicative of lymphoma or another type of metastatic cancer. A treatment team was then put in place while the plaintiff’s life became completely capsized by the diagnosis.
Multiple testing was done including but not limited to blood tests and GI scopes which caused him much distress. He was also told that the cancer could have spread to his vital organs and that the outlook was bleak.
When the tests results came back negative for cancer, the plaintiff then submitted to an endoscopy and a colonoscopy. The gastroenterologist informed the plaintiff that the cause of the pain and bulge in his stomach was non-other than the hernia mesh that had been put there.
Being under the impression that you have cancer and then knowing you are cancer free of course is a wonderful relief. However, the plaintiff continues to endure unbelievable physical pain due to the hernia mesh device including aches, fever, high blood pressure and unexplained pain in his groin.
