DePuy ASR Trial Update
The first trials involving DePuy ASR hip replacement lawsuits were scheduled to begin in early 2013. These DePuy ASR hip replacement recall trials will be important because they will gauge how juries might rule in similar claims, and could influence settlement negotiations. The first two DePuy ASR trials for claims filed in the federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio (MDL 2197) are scheduled to begin May 6, 2013 and July 8, 2013 respectively. The first DePuy ASR trial was supposed to begin in Maryland state court in January 2013. However, on the day of opening statements, the Plaintiff withdrew her case and was reportedly planning to re-file her lawsuit in the DePuy ASR hip litigation underway Ohio federal court.
DePuy ASR Trial Los Angeles
In February 2013, a Los Angeles Superior Court jury began hearing claims in a state DePuy ASR lawsuit. During trial, a large amount of evidence was introduced that raised questions about Johnson Johnson and DePuy Orthopedics’ handling of the ASR, and that indicated the companies were aware of its problems years before the DePuy ASR recall. The trial ended with the jury awarding $8.3 million to the Plaintiff, after finding DePuy was liable for selling a defective hip implant.
DePuy ASR Trial Illinois
Shortly after the DePuy ASR trial ended in Los Angeles, jury selection began in another in Chicago, Illinois. During opening statements, the attorney for the Plaintiff in the Illinois DePuy ASR trial argued that even before she received her hip implant, “DePuy knew that the design flaws in this defective device could cause it to shed those particles into patients, causing tissue death, causing high blood metal ion levels and the need for the serious and unnecessary second surgery.”
DePuy ASR Hip Recall
The DePuy ASR hip system recall was announced in August 2010, System, after data from the National Joint Registry of England and Wales showed that 1 out of every 8 patients (12%-13%) who had received the devices had to undergo revision surgery within five years of receiving it. The recall involved both the ASR Hip Resurfacing System and ASR Acetabular System; however, only the ASR Acetabular System was sold in the U.S. Prior to the DePuy ASR Hip recall, roughly 93,000 defective ASR hip replacements were sold by DePuy and implanted in patients in the U.S. and abroad.
DePuy ASR Hip Recall FDA Response
In the wake of the DePuy ASR hip system recall, the U.S. Food Drug Administration (FDA) launched a review of metal-on-metal hip implants. In July 2012, an FDA advisory panel concluded there were few reasons to use such devices. In January 2013, the FDA advised patients with such implants to undergo metal ion testing and imaging screening if they were experiencing symptoms of a failing hip implant. The agency also proposed a new rule that would reclassify metal-on-metal hips as high-risk medical devices, which would require they undergo human tests before coming on the market.
DePuy ASR Settlement News
So far, only a handful of plaintiffs have reached a DePuy ASR settlement with Johnson Johnson. In late August 2012, three plaintiffs in a DePuy ASR lawsuit scheduled to go to trial in Nevada state court reached a settlement amounting to roughly $200,000 per plaintiff. However, it is widely believed that the figure is well below what DePuy and Johnson Johnson could be expected to pay.
A DePuy ASR Settlement in 2013?
It’s too early to say if there will be a DePuy ASR Settlement in 2013. However, in late 2012 Bloomberg.com reported that Johnson Johnson had offered a global settlement averaging about $200,000 per claim. Plaintiffs’ attorneys rejected the offer as too low. Following the verdict in the Los Angeles trial, some experts speculated that Johnson Johnson might renew efforts to reach a DePuy ASR settlement. It is believed such a settlement could cost the company around $3 billion.
Depuy ASR Hip Replacement Symptoms Complications
Hundreds of patients fitted with the DePuy ASR hip replacement system have been forced to undergo painful revision surgery after suffering serious complications related to the failing devices. Some of these DePuy ASR hip replacement symptoms and complications include:
