The Paragard IUD is a method of birth control. Unlike other IUDs available to women, the Paragard IUD does not utilize hormones to prevent pregnancy from occurring. Teva Pharmaceuticals manufacture the device.
Unfortunately, the Paragard IUD, copper T-380A, might be defective. It is causing a variety of injuries to women across the country because it embeds in the uterus, requiring painful removal surgery. There are also reports that the device breaks, the result of which is also painful, sometimes complicated surgery.
Our lawyers are reviewing cases for women who have been injured by the Paragard IUD. As with the Mirena IUD, which has been at the center of thousands of lawsuits against Bayer, women claim that the device is defective and dangerous and that they were not warned about the risks of using the device.
If you received the Paragard IUD and suffered from surgical complications, call our birth control lawyers at Alonso Krangle, LLP. We can determine if you are eligible to file a claim against Teva and seek monetary damages for your injuries.
The IUD’s Dangerous History
IUDs are widely used around the world. In the United States, however, the rates of IUD use are lower than the rest of the world. Why? It could be because of the Dalkon Shield, which was made The Dalkon Corporation, then by A.H. Robins Company (Robins). Robins sold over 2 million Dalkon Shield IUDs in the early 1970s.
Reports of injuries from the Dalkon Shield were widespread and tragic. Nearly two hundred thousand women testified that they suffered from a variety of problems caused by the IUD. Pelvic infections, sepsis, infertility, unwanted pregnancy, and in some cases, death. The string that was supposed to be used in the removal of the medical device deteriorated inside women’s bodies, causing many of the problems.
The history of the Dalkon Shield is complicated, and it has been off the market for decades. Over 300,000 lawsuits were filed against Robins. Robins paid 245 million dollars to settle nearly 8 thousand of the lawsuits. They subsequently established a fund for 650 million dollars to settle the remaining claims.
IUDs fell out of favor after the Dalkon Shield proved to be so dangerous. However, millions of women in the US currently use an IUD as their preferred form of birth control.
The Paragard IUD is Supposed to Be Safe
The Paragard IUD is marketed as a safe, reversible, hormone-free, effective birth control device. According to the Paragard website:
“Paragard is a small, hormone-free IUD made of soft, flexible plastic wrapped with a thin layer of copper. It’s placed in your uterus by a healthcare provider during an office visit in just a few minutes. Paragard lasts up to 10 years, but can be removed at any time sooner. If you decide you want to get pregnant or stop using it, your healthcare provider can remove it.”
There are warnings on the website about possible side effects and complications. There are allegations that Teva’s warnings are insufficient in stating the true nature of the risks associated with using the Paragard IUD.
Women Injured by the Paragard are Suing Teva Pharmaceuticals
Women are filing lawsuits against the makers of the Paragard IUD alleging it did not adequately warn about the risks of the device breaking during the removal process. The surgery needed to remove a broken IUD can be painful and cause permanent damage to the uterus and nearby organs. The lawsuits also allege that the IUD has a design defect that adds to the risk.
Are You Eligible to File a Paragard Lawsuit?
Did you get a Paragard IUD? Did the Paragard perforate your uterus? Did the Paragard break apart? Did you require surgery to remove it? If you can answer “yes” to these questions, consider if filing a claim is right for you. You might be able to collect damages from Teva Pharmaceuticals.
What Damages are Available?
You might be able to collect money for such things as:
- Medical expenses and other actual costs associated with your injury from the Paragard IUD and treatment
- Lost income from missing work due to side effects and your recovery
- Pain
- Suffering
- Emotional trauma
